Swearing an Affidavit in a British Columbia Divorce
An affidavit may be the evidence of a party in support of his or her British Columbia divorce, or it may be the evidence of another person, such as a process server. The person whose evidence is in the affidavit must swear or affirm that the contents are true in order for the affidavit to be admissible in court.
The affidavit must be sworn before a commissioner for taking affidavits. All lawyers, notaries public and also certain staff at the court registry are commissioners.
In a British Columbia divorce there are several affidavits that may be required depending on your situation:
- In a British Columbia sole divorce there is an affidavit of the plaintiff, and an affidavit of service. If there are children of the marriage, there will also be a child support affidavit.
- In a British Columbia joint divorce there is an affidavit of party 1 and an affidavit of party 2. If there are children of the marriage, there will also be a joint child support affidavit.
Supporting Documents
Many affidavits used in a British Columbia divorce require supporting documents. Documents that support the information or claims you are making in an affidavit are called exhibits. The following rules apply to exhibits:
- Each exhibit must be referenced sequentially in the affidavit beginning with Exhibit A.
- Each exhibit must be stamped and signed by the commissioner for swearing affidavits.
