BC Sole Divorce Overview
If one spouse is asking the other spouse for a divorce in BC, it is called a BC Sole Divorce. In a sole divorce in BC the cooperation or participation of the other spouse is not required. Only the applicant spouse signs the divorce papers and the other spouse is served. If the participation of your spouse is likely, you may want to consider a Joint Divorce in BC.
The BC Sole Divorce Process
There are two required stages in order to obtain a sole divorce in BC and a third optional stage if you require a Certificate of Divorce. In stage 1 the applicant spouse signs the Writ of Summons and Statement of Claim, which are then filed with the court. A filed copy of these papers must then be served on your spouse by having someone other than you give them to your spouse in person. See Process Service for more information on serving your spouse.
Uncontested Divorce
If your spouse does not file an Appearance or Statement of Defence to your Writ of Summons and Statement of Claim, then your Sole Divorce in BC is uncontested and you can proceed with stage 2 without any further notice to your spouse. In stage 3, if you require a Certificate of Divorce, you may sign the Requisition to obtain one when the divorce is final.
