British Columbia Affidavit of Translation
If your certificate of marriage is not in English, you can still apply for divorce in British Columbia. Your certificate of marriage must be translated and attached as an exhibit to a sworn affidavit of translation, which must be filed with the court. The court requires that the translator provide a sworn affidavit of translation in order to accept your non-English certificate of marriage.
The certificate of marriage must be translated by someone, other than you or your spouse, who is fluent in the language of the certificate of marriage and English. The translator must swear an affidavit of translation, which sets out the name and qualifications of the translator and the details of the translation itself.
The affidavit of translation must be sworn by the translator before a notary or commissioner for taking affidavits. The original certificate of marriage and it's translation must be attached as exhibits. You must file the sworn affidavit of translation with the court together with the Writ of Summons and Statement of Claim in your British Columbia Divorce.
