Process Service in a BC Divorce
In a BC sole divorce it is necessary to have a copy of the filed Writ of Summons and Statement of Claim served on your spouse personally. If you are the Plaintiff, you must arrange for a copy of these documents to be served on your spouse by having someone other than you give a copy of them to your spouse in person.
The person serving your spouse must provide you with a sworn affidavit of service, which you must file with the court. The affidavit of service sets out the details of the service and confirms to the court that your spouse has been personally notified that you are filing for divorce in BC.
